Public appointment and swearing-in
The public appointment as a "Publicly Certified Expert" is based on § 36 of the Trade, Commerce and Industry Regulation Act. It is a sovereign act which is also exercised by non-governmental bodies, e.g. the Chambers of Industry and Commerce (IHK).
The requirement for a public appointment is proof of the special expertise to be provided by the expert within the scope of an examination procedure.
Public appointment is possible in various fields, including
- the valuation of developed and undeveloped properties
- structural damages
- rents and leases.
The claim that the public appointment is a German special path without comparable qualifications abroad is widespread. However, this is not correct, in many countries, a similar recognition of highly qualified experts by civil or appeal courts takes place. E.g. in Austria as "sworn and court-certified experts" or in France as "experts judicairs".

Certification according to EN ISO/IEC 17024
An alternative proof of special expertise is the certification of persons according to EN ISO/IEC 17024 which is regulated on the European scale.
The certification as a "Real Estate Valuer for Financial Purposes" by HypZert-GmbH in Berlin (CIS HypZert [F]) has meanwhile become a key requirement for experts in the credit economy. Furthermore, certification authorizes the preparation of expert opinions for tax purposes in accordance with § 198 BewG.

Chartered Surveyors (MRICS, FRICS)
The Royal Institution of Chartered Surveyors (RICS) is a professional institution for professions in the real estate industry that has been in existence since 1868 and operates worldwide. Qualified members bear the designations MRICS, FRICS or HonRICS and are collectively named as Chartered Surveyors. The requirement is the completion of an Assessment of Professional Competence (APC) which is offered for various specializations including valuation.
The designation „Chartered Valuation Surveyor“ is usual for experts who are qualified RICS members.

Engineer
In the past, the qualification was awarded as an academic degree by universities as "Diplom-Ingenieur" or "Diplom-Ingenieur (FH)". These have since been replaced by Bachelor's and Master's degrees. In addition, the chambers of engineers award the professional titles "engineer" or "consulting engineer" to qualified persons working in practice.
